Terms of Service
These Terms of Service ("Terms") govern your access to and use of the TrueStare website and API (the "Service"), available at https://truestare.com. By using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.
1. Acceptance
By accessing or using the Service, you confirm that you are at least 13 years old (or the minimum age required to use online services in your jurisdiction) and that you have read, understood, and accept these Terms. We may update these Terms periodically; continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.
2. About the Service
TrueStare provides a hosted API for real-time market data (trending keywords, crypto market data, domain enrichment), AI text processing (PII detection, contract clause extraction, content moderation), and automation workflows. The Service is provided on a freemium basis — free tiers are available with usage caps; paid tiers expand those caps. See the pricing page for current limits.
3. Accounts and API keys
To use the API beyond unauthenticated demo endpoints, you must create an account and generate an API key. You are responsible for keeping your API key confidential and for all activity that occurs under your key. If you believe your key has been compromised, rotate it immediately from your dashboard. We are not responsible for losses caused by unauthorized use of your key.
You may not share your account credentials, sublicense your API key to third parties, or use a single account to serve multiple unrelated end-customers without a Business-tier subscription.
4. Acceptable use
When you use the Service, you agree that you will not:
- Violate any applicable law, regulation, or third-party right
- Send or process content that is illegal, defamatory, harassing, or that infringes copyright or trademark
- Use the Service to send unsolicited bulk email (spam) or to facilitate illegal data collection
- Attempt to disrupt or interfere with the Service, its servers, or its networks (including DDoS, exploit-probing, or rate-limit evasion)
- Reverse engineer, decompile, or attempt to extract the Service’s source code or proprietary models
- Resell the raw output of the Service as a competing data product without prior written agreement
- Use automated tools to circumvent free-tier rate limits by creating multiple accounts
We reserve the right to suspend or terminate accounts that violate these rules. We may also rate-limit, throttle, or block specific API keys at our discretion to protect Service stability.
5. Intellectual property
All design, code, branding, documentation, and content of the website are owned by us. The data returned by the Service (market data, AI-generated text outputs) is licensed to you for your business use under your active subscription tier. You may use that output in your own products and services subject to the acceptable-use rules above.
Aggregated, anonymized usage data may be used by us to improve the Service.
6. Subscription, billing, and refunds
Paid subscriptions renew automatically each billing period (monthly or annual) until canceled. You can cancel at any time from your dashboard; cancellation takes effect at the end of the current billing period and you retain access through that period.
We do not offer prorated refunds for partial periods. If you experience a billing error, contact [email protected] within 30 days and we will work to resolve it. Annual subscriptions paid up-front are refundable on a prorated basis within 14 days of purchase.
We may change pricing for new sign-ups at any time. Existing subscriptions are honored at their current price for the remainder of the active billing period; changes take effect at next renewal with at least 30 days’ notice.
7. Disclaimer
The Service is provided "as is" and "as available", without warranty of any kind, express or implied. While we make reasonable efforts to keep the Service accurate, fast, and reliable, we do not warrant that:
- The Service will be uninterrupted, error-free, or free of harmful components
- Market data, keyword trends, or AI-generated outputs will be accurate, complete, or fit for any particular purpose
- The Service will be compatible with your existing systems or third-party integrations
- Any information we provide constitutes financial, legal, or other professional advice
You are solely responsible for your use of the Service and for the decisions you make based on its outputs. If your use case involves regulated decision-making (financial, medical, legal), consult a qualified professional and do not rely solely on the Service.
8. Limitation of liability
To the fullest extent permitted by law, in no event will TrueStare, its operators, contributors, or service providers be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, goodwill, or business opportunity, arising out of or in connection with your use of the Service, even if we have been advised of the possibility of such damages.
To the fullest extent permitted by law, our total aggregate liability to you for any claim arising from your use of the Service is limited to the greater of (a) the amount you paid us in the 12 months preceding the event giving rise to the claim, or (b) one hundred US dollars ($100).
9. Service availability and changes
We may modify, suspend, or discontinue any part of the Service (including specific endpoints, features, or pricing tiers) at any time. For material changes affecting paid customers, we will provide at least 30 days’ notice via email to the account address.
We do not guarantee a specific uptime SLA on free tiers. Paid tiers have a target of 99.5% monthly availability; if we fall below that and you are on a Pro or Business plan, contact support for service credit.
10. Termination
You may close your account at any time from the dashboard. We may suspend or terminate your account, with or without notice, if you violate these Terms or if your use of the Service threatens its stability or security. The provisions of Sections 5, 7, 8, 11, and 12 survive any termination.
11. Governing law
These Terms are governed by the laws of the United States and the state in which the Service’s operator resides, without regard to conflict-of-law principles. Any dispute arising under these Terms will be resolved in the state or federal courts of that jurisdiction, and you consent to the exclusive jurisdiction of those courts.
12. Severability and entire agreement
If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force and effect. These Terms constitute the entire agreement between you and TrueStare with respect to the Service and supersede any prior agreements or understandings.
